Business/Rental Insurance Registry
The Legislature recently enacted P.L. 2011, C. 92, which amends N.J.S.A. C.40A, et. seq. to impose a requirement on all New Jersey businesses and all New Jersey owners of certain rental units to obtain liability insurance and to register with the municipality in which the business or rental units are located, to demonstrate proof of such insurance. The Legislature has imposed upon New Jersey municipalities the obligation to maintain a municipal record of such registrations, and allows municipalities to charge a reasonable administrative fee to maintain such a registry.

Ordinance of the Borough of Rockaway Mayor and Council Amending Chapter 173 "Licenses and Permits" of the Code of the Borough of Rockaway
WHEREAS, the Legislature recently enacted P.L. 2011, C. 92, which amends N.J.SA. C.40A:10A, et. seq. to impose a requirement on all New Jersey businesses and all New Jersey owners of certain rental units to obtain liability insurance and to register with the municipality in which the business or rental units are located, to demonstrate proof of such insurance; and
WHEREAS, the Legislature has imposed upon New Jersey municipalities the obligation to maintain a municipal record of such registrations, and allows municipalities to charge a reasonable administrative fee to maintain such a registry.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Rockaway, County of Morris, State of New Jersey, that the following amendments be made to Chapter 173, "Licenses and Permits" of the Code of the Borough of Rockaway:
Section 1. Section 173 "Licenses and Permits" of the Code of the Borough of Rockaway is hereby amended by the addition of a new Article II, entitled "Business/Rental Insurance Registry" which shall read in its entirety as follows:
- The owner of a business located within Rockaway Borough shall maintain liability insurance for negligent acts or omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
- The owner of a rental unit or units located within Rockaway Borough shall maintain liability insurance for negligent acts or omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
- The owner of a multi-family home of four or fewer units, one of which is owner occupied, located within Rockaway Borough shall maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence
- Each person set forth in Sections A through C of this Article shall file with the Borough a certificate of insurance as evidence of the level of coverage as required by this Ordinance, and shall at the same time submit a payment in the amount of $125 per Initial Certificate or $50 per Renewal Certificate. Upon the filing of an insurance certificate and the requisite fee, the Borough Clerk shall issue a certificate of registration to the owner stating the amount of coverage and the policy period of the insurance policy or policies evidenced by the certificate of insurance.
- The obligation to file an insurance certificate for a business in Rockaway Borough applies within thirty (30) days after the effective date of this Ordinance. If the business is established after the effective date of this Ordinance, the obligation to file an insurance certificate for a business in Rockaway Borough applies within thirty (30) days of the date that the business is established.
- The obligation to file an insurance certificate for rental units or for a multi-family home of four (4) or fewer units, one of which is owner-occupied, applies within thirty (30) days after the effective date of this Ordinance. If the rental units or the multi-family home are acquired after the effective date of this Ordinance, the obligation to file an insurance certificate applies within thirty (30) days after such acquisition.
- The requirement to file a certificate of insurance as set forth in this Ordinance applies on an annual basis, and the certificate shall be filed on or before January 15 of each year.
- If the owner of a business, or of a rental unit or units, or the owner of a multi-family home of four or fewer units, one of which is owner occupied, fails to file the required certificate of insurance with Rockaway Borough and/or pay the corresponding fee as required in subsection b.1 within ten (10) days of any applicable deadline, Rockaway Borough may bring an action to impose a fine of not less than $500 but no more than $5,000 pursuant to N.J.S.A. 2A:58-10 et seq. (the "Penalty Enforcement Law of 1999").
Section 2. This Ordinance may be renumbered for codification purposes.
Section 3. Severability. The provisions of this ordinance are hereby declared to be severable. Should any section, paragraph, subparagraph, provision, sentence, or part hereof be declared invalid or unconstitutional, said finding shall not affect any other section, paragraph, subparagraph, provision, sentence, or part thereof.
Section 4. Repealer. All ordinances or parts of ordinances of the Borough of Rockaway which are inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency.
Section 5. Prior Actions. All actions of the Borough of Rockaway taken prior to the date of adoption hereof contemplated by this Ordinance are hereby ratified and approved.
Section 6. Effective Date. This Ordinance shall take effect immediately upon final passage and publication according to law.

Chapter 92
AN ACT requiering liability insurance for business owners and rental unit owners and supplementing Title 40A of the New Jersey Statutes.
BE IT ENACTED by the Senate and General Assembly of the State of New Jersey:
C.40A: 1 0A-1 Liability insurance, negligent acts, omissions; business owners, rental unit, units owner.

- Except as provided in subsection b. of this section, the owner of a business or the owner of a rental unit or units shall maintain liability insurance for negligent acts and omissions in an amount of no less than $500,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
- The owner of a multifamily home which is four or fewer units, one of which is owneroccupied, shall maintain liability insurance for negligent acts and omissions in an amount of no less than $300,000 for combined property damage and bodily injury to or death of one or more persons in any one accident or occurrence.
C.40A: 1 0A-2 Certificate of insurance, annually registration, municipality of business, rental units, multi-family home.

- The owner of a business, owner of a rental unit or units, and the owner of a multifamily home of four or fewer units, one of which is owner occupied, shall annually register the certificate of insurance demonstrating compliance with section 1 of this act with the municipality in which the business, rental units, or multi-family home is located.
- The governing body of a municipality may, by ordinance, establish a reasonable administrative fee for the certificate of registration required pursuant to subsection a. of this section for properties located in that municipality. The governing body of a municipality may collect, through a summary proceeding pursuant to the "Penalty Enforcement Law of 1999," P.L.1999, c.274 (C.2A:58-10 et seq.), a fine of not less than $500 but no more than $5,000 against an owner who failed to comply with the provisions of this act.

- The provisions of subsection a. of section 1 of this act shall take effect on the 90th day next following enactment for all new policies issued on or after the 90th day following enactment and shall take effect on the 180th day next following enactment for all policies in force on the date of enactment that are renewed on or after the 180th day following enactment.
- The provisions of subsection b. of section 1 of this act shall take effect on the 180th day next following enactment and shall apply to policies issued or renewed on or after the 180th day following enactment.
- The provisions of section 2 of this act shall take effect on the 90th day next following enactment.
